A policy of not labeling used oil as hazardous waste so as not to frighten off service stations and others as recycling sites was struck down by a federal appeals court. The Environmental Protection Agency in 1986 had avoided the hazardous designation for used oil to encourage recycling. But the panel of the U.S. Circuit Court of Appeals in Washington said that factor cannot be taken into account, since EPA had concluded that a broad category of used oils were hazardous wastes.
